In Massachusetts, if both spouses want a divorce, an uncontested divorce is possible. If one wants a divorce, but the other does not, then a contested divorce is required. If one person doesn’t want the divorce, that doesn’t mean, you can’t get divorced. It just means you have to go through the court process. Litigation isn’t the only way to obtain a divorce if you both agree to work together to resolve the issues needing to be determined in a divorce. Mediation, conciliation, and collaborative law are different avenues of helping two people come to agreements on the issues that need to be determined before a Judge will grant your divorce in Massachusetts.
