Required Co-Parenting Course in Certain Massachusetts Divorce and Custody Cases

Effective November 1, 2023, separating families in certain family law cases in Massachusetts can be ordered by a judge to complete the co-parenting course Two Families Now. We’re going to go over what the recent Probate and Family Court order says and how it might affect your Massachusetts divorce or custody case. 

Who is Affected?

If you file for any of the following types of cases on or after November 1, 2023, and custody or parenting time of minor children is involved, then you will be ordered to take the Two Families Now Course…

  • Annulments
  • Contested Divorces (not 1A’s)
  • Complaints to establish custody or parenting time (including paternity cases)
  • Any post-judgment litigation involving custody and/or parenting time (this includes cases involving a contempt and/or modification)

What is the Required Course?

The Two Families Now Course:

  • Takes 4-6 hours to complete
  • Can be taken at your own pace on smartphone, tablet, or computer
  • Costs $49 per parent (you have access to the course for 30 days after payment)

What if I Can’t Afford the Two Families Now Course?

If the course fee would provide an undue hardship because of your current financial situation, you may be able to submit an affidavit of indigency and receive a fee waiver for the course. 

Can I Get the Requirement Waived?

If you and your soon-to-be-ex come to an agreement on parenting time and custody issues which is filed with the court within 60 days of service of the summons, the requirement is automatically waived. You may also file a motion to request a waiver of attendance and ensure that parties are notified as necessary so that the judge may then determine whether you have cause for that waiver to be granted.
